The organizer is the sole contact person and person responsible for conducting the competition TREOS GmbH.
2. Participation Period
The competition begins on [date] at [time] and ends on [date] at [time] (hereinafter “participation period”). Entries received after the end of the participation period will not be considered.
3. Participation
Participation is free and takes place via the Instagram platform. To participate, the following requirements must be met cumulatively within the participation period:
- Follow the Instagram account @erlebedasbad.
- The Instagram account @steinberg.follow fittings.
- Please state in a comment under the competition post which color of the stool you prefer.
Voluntarily sharing the post in your own Instagram story is not a prerequisite for participation and does not increase your chances of winning. Only one entry per person is permitted. Using multiple Instagram accounts for multiple participation is not permitted and will result in exclusion.
4. Eligibility
Natural persons who have reached the age of 18 at the time of participation and are resident in the Federal Republic of Germany are eligible to participate. Employees of the organizer and the cooperation partner as well as their relatives within the meaning of Section 15 AO are excluded from participation.
5. Profit
One (1) will be raffled off Steinberg Polyresin stool from the online shop ERLEBE DAS BAD. The color can be freely selected from the variants available at the time the prize is handed over. If the desired color specified in the comment is not in stock, one of the available alternatives will be offered. A cash payment of the prize value, an exchange for other goods or a transfer of the prize claim to third parties are excluded.
6. Winner Determination and Notification
The winner will be determined after the end of the participation period by a random process (draw using a random generator) from all valid entries. The notification is sent via direct message via Instagram. If the person selected does not respond within seven (7) calendar days of sending the notification or if the prize cannot be delivered for a reason for which the winner is responsible, the claim to the prize will expire. In this case, the organizer is entitled to determine a replacement person through another draw.
7. Early Termination
The organizer reserves the right to cancel or end the competition in whole or in part at any time without prior notice and without giving reasons, provided there is an objective reason for this (e.g. technical malfunctions, suspected manipulation, changes to the platform conditions by Instagram). Any claims by participants to the competition being held are excluded in such a case.
8. Disclaimer/Note about Instagram
The competition is not affiliated with Meta Platforms Ireland Limited (Instagram) and is in no way sponsored, endorsed or organized by Instagram. The contact person is exclusively the organizer. To the extent permitted by law, the organizer is not liable for technical disruptions to the Instagram platform or for the loss of comments, messages or other content caused by third parties.
9. Data protection
The person responsible within the meaning of the General Data Protection Regulation (GDPR) for the data processing carried out as part of the competition is

- a) Processed data: As part of the competition, the Instagram user name, the comment content and, in the event of a win, the winner's real name and delivery address are processed.
- b) Purpose and legal basis: The processing is carried out for the purpose of carrying out the competition (determination and notification of the winner, dispatch of the prize). The legal basis is Article 6 Paragraph 1 Letter b GDPR (fulfillment of the competition contract resulting from participation).
- c) Disclosure to third parties: The winner's delivery data will be passed on to the appointed logistics service provider exclusively for the purpose of shipping the prize. There will be no further transfer to third parties
- d) Storage period: The data will be deleted after the competition has been completed and a reasonable period of three months has elapsed after the prize has been handed over, unless this is contrary to statutory retention requirements.
- e) Rights of those affected: Participants have the right to information (Article 15 GDPR), correction (Article 16 GDPR), deletion (Article 17 GDPR), restriction of processing (Article 18 GDPR), data portability (Article 20 GDPR) and objection to processing (Article 21 GDPR) vis-à-vis the person responsible. There is also a right to lodge a complaint with the responsible supervisory authority (State Commissioner for Data Protection and Freedom of Information for North Rhine-Westphalia, PO Box 20 04 44, 40102 Düsseldorf).
10. Severability clause
If individual provisions of these terms and conditions of participation are or become ineffective, the effectiveness of the remaining provisions remains unaffected.
11. Applicable Law
The law of the Federal Republic of Germany applies.
